1. Aceptación de los Términos

Al acceder, navegar o utilizar la plataforma SentianOrbit (en adelante, "el Propietario"), ya sea a través de la web o de sus APIs, usted ("el Usuario") reconoce haber leído, entendido y aceptado estar vinculado por estos Términos de Servicio, así como por todas las leyes y regulaciones aplicables en España y el Derecho Internacional.

2. Naturaleza Consultiva del Servicio e Inexactitud

SentianOrbit es una herramienta de inteligencia experimental basada en datos satelitales procesados por inteligencia artificial. El Usuario reconoce que:

• Los datos satelitales (Copernicus) pueden contener errores de latencia, nubes, interferencias electromagnéticas o fallos del sensor.
• Los algoritmos de IA pueden producir "falsos positivos" o "falsos negativos".
• Garantía Cero: No garantizamos que los datos sean exactos, oportunos o veraces. El Propietario se exime de cualquier responsabilidad penal o civil por decisiones operativas basadas en estos datos.

3. Limitación Absoluta de Responsabilidad

En ningún caso SentianOrbit, sus fundadores, desarrolladores, socios o proveedores de datos serán responsables por cualquier daño directo, indirecto, incidental, punitivo, especial o consecuente, o por cualquier pérdida de beneficios, ingresos, datos o uso, ya sea en una acción de contrato, agravio (incluyendo negligencia) o cualquier otra teoría legal, que surja de su acceso o uso de la Plataforma.

Esto incluye, pero no se limita a, catástrofes marítimas, sanciones gubernamentales, pérdidas económicas por informes de "Sealed Evidence" o detenciones ilegales basadas en interpretaciones erróneas del usuario.

4. Indemnización y Blindaje Legal

El Usuario acepta defender, indemnizar y mantener indemne a SentianOrbit y a sus propietarios individuales frente a cualquier reclamación, daño, obligación, pérdida, responsabilidad, coste o deuda (incluidos los honorarios de abogados) que surjan de:

• Su uso y acceso a la Plataforma.
• Su violación de cualquier término de estos Términos.
• Su violación de cualquier derecho de terceros, incluido el derecho de privacidad o propiedad intelectual.
• Cualquier acusación penal derivada de acciones tomadas basándose en la información proporcionada por la Plataforma.

5. Uso Prohibido y Actividades Ilegales

Queda terminantemente prohibido utilizar SentianOrbit para:

• Vigilancia ilegal de activos estatales o militares protegidos.
• Facilitar actividades de contrabando, piratería o pesca ilegal.
• Acosar o rastrear embarcaciones privadas sin consentimiento legal o gubernamental.
• Ingeniería inversa de los algoritmos de detección para beneficio de potencias extranjeras u organizaciones criminales.

6. Jurisdicción y Resolución de Conflictos

Cualquier disputa relacionada con estos términos se regirá exclusivamente por las leyes de España. El Usuario renuncia expresamente a cualquier otra jurisdicción que pudiera corresponderle y acepta someterse a la competencia exclusiva de los Juzgados y Tribunales de España para la resolución de cualquier conflicto.

7. Modificaciones y Terminación

El Propietario se reserva el derecho de modificar estos términos en cualquier momento. La continuación del uso tras dichas modificaciones constituye una aceptación. SentianOrbit se reserva el derecho de terminar el acceso de cualquier usuario sin previo aviso si se sospecha de un uso que comprometa la seguridad nacional o la integridad penal de la empresa.

1. Acceptance of Terms

By accessing, browsing, or using the SentianOrbit platform (hereinafter, "the Owner"), whether via web or its APIs, you ("the User") acknowledge having read, understood, and agreed to be bound by these Terms of Service, as well as all applicable laws and regulations in Spain and International Law.

2. Advisory Nature and Inaccuracy Disclaimer

SentianOrbit is an experimental intelligence tool based on satellite data processed by artificial intelligence. The User acknowledges that:

• Satellite data (Copernicus) may contain latency errors, clouds, electromagnetic interference, or sensor failures.
• AI algorithms may produce "false positives" or "false negatives."
• Zero Warranty: We do not guarantee that the data is accurate, timely, or truthful. The Owner disclaims all criminal or civil liability for operational decisions based on this data.

3. Absolute Limitation of Liability

In no event shall SentianOrbit, its founders, developers, partners, or data providers be liable for any direct, indirect, incidental, punitive, special, or consequential damages, or for any loss of profits, revenue, data, or use, whether in an action of contract, tort (including negligence), or any other legal theory, arising from your access to or use of the Platform.

This includes, but is not limited to, maritime catastrophes, government sanctions, economic losses from "Sealed Evidence" reports, or illegal detentions based on erroneous user interpretations.

4. Indemnification and Legal Shield

The User agrees to defend, indemnify, and hold harmless SentianOrbit and its individual owners against any claims, damages, obligations, losses, liabilities, costs, or debts (including attorney's fees) arising from:

• Your use and access to the Platform.
• Your violation of any term of these Terms.
• Your violation of any third-party rights, including privacy or intellectual property rights.
• Any criminal charges derived from actions taken based on the information provided by the Platform.

5. Prohibited Use and Illegal Activities

It is strictly prohibited to use SentianOrbit for:

• Illegal surveillance of protected state or military assets.
• Facilitation of smuggling, piracy, or illegal fishing activities.
• Harassment or tracking of private vessels without legal or governmental consent.
• Reverse engineering of detection algorithms for the benefit of foreign powers or criminal organizations.

6. Jurisdiction and Dispute Resolution

Any dispute related to these terms shall be governed exclusively by the laws of Spain. The User expressly waives any other jurisdiction that may apply and agrees to submit to the exclusive jurisdiction of the Courts and Tribunals of Spain for the resolution of any conflict.

7. Modifications and Termination

The Owner reserves the right to modify these terms at any time. Continued use following such modifications constitutes acceptance. SentianOrbit reserves the right to terminate access for any user without prior notice if misuse compromising national security or the company's criminal integrity is suspected.
